The effective date of the latest version of the agreement, as stated below, indicates the last time the agreement was materially modified. Checking the effective date below allows you to determine whether there have been material modifications since the last time you reviewed the agreement.

Sorrelli may terminate this agreement at any time, without notice to you, if it believes, in its sole judgment, that you have breached or may breach any term or condition of this agreement, or it may terminate this agreement for its convenience.

You may terminate this agreement at any time by destroying all materials received from the website and ceasing to use the website.

Dispute Resolution

This agreement has been made in and shall be construed in accordance with the laws of the State of Pennsylvania. By using this website, you agree to the sole and exclusive venue and jurisdiction of the state and federal courts of Berks County, Pennsylvania, for any and all disputes arising out of or related to this agreement or the use of this website. You agree to defend, indemnify, and hold Sorrelli harmless from and against any and all claims, damages, costs, and expenses, including attorneys' fees, arising from or related to your use of the website.

Indemnity

You agree to defend, indemnify, and hold harmless Sorrelli and its officers, directors, employees, appointed agents, or their respective successors and assigns; from and against any and all claims, damages, costs, and expenses whatsoever, including without limitation attorneys’ fees, arising from or relating to directly or indirectly your use of, reliance on, publication, distribution or communication, uploading or downloading anything on or from the website.

SORRELLI SMS/TEXT PROGRAM

By participating in the SORRELLI SMS/Text Program (the "SMS Program"), you agree to be bound by the terms and conditions set forth herein. To see how SORRELLI collects and uses your personal information, please see our Privacy Policy. In addition, please review the SORRELLI Terms Of Service, which additionally governs your participation in the SMS Program.

SMS Program Content: SORRELLI will provide SMS and/or MMS messages and other mobile contacts with member/consumer content, including coupons, advertisements, events, releases polls, giveaways, downloads and information alerts from SORRELLI along with future content which may be of specific interest to our individual customers.
Message Frequency: The SMS Program is a subscription-based program and SMS Program participants will receive a maximum of 12 messages per month. SORRELLI will occasionally offer the option to opt-in to additional mobile messages for specific promotions for a specified amount of time.
Authorized Participation: By enrolling in the SMS Program, you certify that you are 18 years of age or older, and are authorized: (a) to enroll the designated mobile phone number in the SMS Program, and (b) to incur any mobile message or data charges that may be incurred by participating in the SMS Program. Your consent to receive SMS and/or MMS messages is not a condition of purchase of any products or services, and no purchase is necessary. In the event that you change or deactivate your mobile number, it is your responsibility to notify SORRELLI at 610.898.3500 to have your number removed.
Technology Used To Send Messages: You understand that we will send SMS and MMS messages using automated technology including through an automatic telephone dialing system.
To Stop Messages or Opt Out: To stop receiving SORRELLI Mobile text messages, reply STOP to any SORRELLI text message, Text STOP to 94921, or contact the SORRELLI Customer Service team at 610.898.3500. If opting-out via a STOP reply message, you consent to receive an additional text message confirming your opt-out request. Please allow up to five (5) business days to process your request.

Cost to Participate: Participation in the SMS Program is free; however, Message and Data rates may apply. Check your mobile plan for details. SORRELLI is not responsible for any messaging or data charges incurred by SMS Program participaNTS. You are responsible for obtaining and maintaining all mobile devices and other equipment and software, and all internet service provider, mobile service, and other services needed for your access to and use of the SMS Program, and you will be responsible for all charges related to them.
Carriers Information: The mobile carriers are not liable for delayed or undelivered messages. SMS Program may not be available through all carriers.
Indemnification: Terms of Use on Indemnification is expressly incorporated in these SMS Program Terms & Conditions by this reference. By signing up for the SMS Program, you acknowledge that any disputes arising out of the SMS Program will be subject to these rules.
Severability: If any provision of these SMS Program Terms & Conditions is for any reason deemed invalid, unlawful, void or unenforceable by a court or arbitrator of competent jurisdiction, then that provision will be deemed severable from these SMS Program Terms & Conditions, and the invalidity of the provision will not affect the validity or enforceability of the remainder of these SMS Program Terms & Conditions (which will remain in full force and effect).

Identity Resolution Privacy Policy

We also engage a third-party partner for the purpose of identifying users and delivering to them marketing on our behalf (i.e. email or direct mail). Our partners may collect information directly from your device, such as your IP address, device ID, and information about your browser or operating system; may combine personal and non-personal information about you with information from other sources; and may place or recognize a unique cookie on your browser.
